Mortgage intermediation in Spain (Ley 5/2019 — LCCI)
In Spain, mortgage intermediation and mortgage advisory are regulated under Ley 5/2019 (LCCI). Individuals or companies that present or offer mortgage contracts, recommend specific mortgage products, advise on mortgage agreements, negotiate mortgage terms, or act as mortgage intermediaries may be required to hold the appropriate registration with the Banco de España or the relevant competent authority.
BuyAPropertyInSpain does not provide mortgage intermediation or mortgage advice. Our calculator and any mortgage figures shown are illustrative estimates only. Before engaging any mortgage broker, intermediary, or advisor in Spain, please verify that they are properly registered and authorised.
Scope of this platform
BuyAPropertyInSpain is an independent buyer-side intelligence platform. Content is produced for general information and decision-support purposes. It is not legal, tax, mortgage, financial, investment, residency or immigration advice. Property values, taxes, interest rates, regulations, and visa rules change frequently and differ by autonomous community and personal circumstances.
Independent professionals
For regulated services we recommend engaging:
- •An independent Spanish lawyer (abogado) registered with a Spanish bar (Colegio de Abogados) for legal due diligence.
- •A mortgage intermediary registered with the Banco de España under Ley 5/2019 for mortgage broking or advice.
- •A Spanish tax adviser (asesor fiscal) for ITP, IVA, IRNR, IBI, plusvalía and wealth tax filings.
- •A regulated currency specialist (FCA-authorised in the UK; equivalent in other jurisdictions) for FX.
- •A licensed Spanish estate agent (API) where regional licensing applies.
