In Spain, mortgage intermediation and mortgage advisory activities are regulated under Ley 5/2019 (LCCI). Individuals or companies that present or offer mortgage contracts, recommend specific mortgage products, advise on mortgage agreements, negotiate mortgage terms, or act as mortgage intermediaries may be required to hold the appropriate registration or authorisation with the Banco de España or the relevant competent authority. This may also apply to professionals such as law firms or advisors whose activities go beyond legal assistance and enter regulated mortgage intermediation or advisory services.
